MALLDECO– is the commercial name of TOP RESERVE BUSINESS S.R.L., a legal entity of Romanian nationality, having the headquarters in Bucharest, Sector 6, Strada Valea Cascadelor, No. 21, Depozitul No. 4, Etaj 1, registered with the Trade Register under no. J40/4671/27.04 2020, having unique registration code 39479180

TERMS
1. Seller: MALLDECO(TOP RESERVE BUSINESS S.R.L..) or any other partner thereof, through the MALLDECO.COM
2. Buyer: any natural or legal person from Romania who places an order.
3. Client: any natural or legal person from Romania who enters the MALLDECO.COM site and has the intention to purchase products.
4. Site: domainMALLDECO.COM and its subdomains.
5. Order: is an electronic document, through which the Buyer transmits to the Seller the intention to purchase certain products from the site.
6. Product: goods sold by MALLDECO (wallpaper, photo wallpaper, sticker, decorative elements, etc.)
7. Contract: represents an Order confirmed by MALLDECO by which TOP RESERVE BUSINESS S.R.L.. agrees to deliver products to the Customer, and the Customer agrees to pay for them.
8. User / visitor: all natural and/or legal persons who access the site for any reason.
9. Personal data: all information that we collect from you, based on which you can be personally identified. These may include your name, address, telephone number, email address, CNP, and for legal entities: Company name, registered office address, CUI, registration no. Reg. Trade, delivery address, email address, telephone number and contact details of the person representing the company. All of these are necessary to issue a tax invoice, which accompanies the goods sent to the Client and the delivery of goods purchased from our site.
10. Content: digital photographs, texts, technical data of the products, prices and other information found on the SITE. The design and content of the site are protected by intellectual property legislation and are entirely the property of TOP RESERVE BUSINESS S.R.L. . The use of the content (images, text, etc.), or any design element, without the written consent of the owner, is punishable in accordance with the laws in force.
11. MEMBER: any natural or legal person who creates an account on the site. If you wish to register, you must complete all the information requested by us. The site administrator may, without any notice or reason, refuse registration or suspend an already registered user.

THE RIGHTS AND OBLIGATIONS OF THE SELLER
1. The seller is obliged to communicate all order costs, product prices, delivery fees, details regarding the ordered products.
2. The Seller, if he has noticed that an order is suspicious, has the right to request additional information, advance payment or full payment by bank transfer, to ensure that the ordered products will be taken over by the Buyer. If he considers it to be a false order, he can cancel it.
3. If the value of the products ordered by the Buyer exceeds the amount of 1500 lei, and the order is suspicious, the Seller has the right to request advance payment or payment by bank transfer. If this is refused by the Buyer, we have the right to cancel the order.

THE BUYER'S RIGHTS AND OBLIGATIONS
1. The Buyer is obliged to provide all the information requested by the Seller, in order to issue an invoice for the ordered products.
2. The Buyer is obliged to keep the original packaging and product labels until the completion of their assembly.
3. The Buyer is obliged to check the integrity of the packages sent by MALLDECO, when they are taken over from the courier. If these packages are not intact (they are hit, torn, broken, etc.), it is mandatory to notify the courier and complete the report. If the package is damaged, the Buyer has the right to refuse the package.
4. The Customer is obliged to check the ordered products before assembly.

LIABILITY
1. The characteristics or price of the products on this site may be modified by MALLDECO, without any prior notice.
2. In the event of erroneous information, due to IT problems, we have the right to cancel your order.
3. The prices of the products on this SITE are informative and may undergo unannounced changes.
4. The description of the products displayed on the MALLDECO.COM site does not represent a contractual obligation on the part of MALLDECO.COM, they being used exclusively for presentation purposes.
5. MALLDECO.COM does not assume responsibility for any price or stock errors. These errors do not oblige MALLDECO.COM to take any action.
6. MALLDECO.COM does not assume responsibility for damaged packages, if a notification has not been made to the delivery person, before taking over the package.

INVOICE AND PAYMENT
1. Payment for products can be made via cash on delivery, through the bank or Online with a bank card.
2. In certain cases, when a product is not in MALLDECO's stock, an advance payment of at least 50% of the total amount is required, which you must pay to a bank, after which you must send us confirmation of payment, in order to place the order. in this case a proforma invoice is sent, and subsequently the original invoice together with the ordered products. If the advance payment is refused by the Client, MALLDECO reserves the right to cancel the order.
3. The prices displayed on this site are expressed in RON and include 19% VAT.

RETURNING PRODUCTS
1. Due to the displays (PC, Laptop, Tablet, Phone) and their settings, please note that there may be differences in shades between the colors of the products displayed on the site and the products themselves.
2. Complaints after the assembly of the products will not be taken into account!
3. Please check the products before installing or using them. We recommend that you have them installed by qualified personnel. If you want to install them yourself, we recommend that you do your research and ask a specialist for correct and useful advice.
4. In the case of wallpaper and photo wallpaper, defects can be: spots of other colors that should not be on the respective model, the joint is not continuous and the model cannot match, or there are differences in shades from one roll to another (with the same manufacturing LOT).
5. Before installation, please check the LOT number (manufacturing number, BATCH NR, ANF NR) on the roll labels, in the case of the same wallpaper model, they must be identical.
6. Before installing the photo wallpaper, please check the parts on a flat surface (if it is made up of several parts), and check the order in which they are installed, they can overlap up to 1cm, depending on the model. If they do not correspond to the image, please contact us before starting installation. ATTENTION! Any complaint must be justified correctly and according to the standards imposed by the manufacturers.
7. According to the Emergency Ordinance OUG 34/2014 if you are not satisfied with the products ordered, you can return them within 14 calendar days, in this case the shipping costs are borne by the Buyer! If the deadline for returning the products has been exceeded, we have the right to refuse to take over the package.
8. Products ordered on an advance basis CANNOT be returned, as they are not part of MALLDECO's stock, so please check the order and the desired products very carefully to ensure that they meet your requirements, when placing the order.
9. The images on this site are representative, the color of the products in reality may differ from the image on the site. (see point 6.1)
10. If you return the ordered products, their value will be refunded within 14 calendar days, after the package arrives at our unit. If after checking the returned products, we find any defect, or that the returned products are not intact, we have the right to refuse to refund the amount paid by the Buyer, and in this case the products will be returned to the Buyer.
11. The address for returning the products is: Bucharest Sector 6, Strada Valea Cascadelor, No. 21, Depozitul No. 4, Etaj 1.
12. All products must be returned in perfect condition, as the goods were sent (with labels included), in appropriate protective packaging. If the package arrives damaged at the store, we have the right to refuse to take it over.
13. If the reason for the return is that the product you ordered does not correspond to what you received or it has defects, the cost of the return will be covered by MALLDECO, if this was noted in the presence of the courier. If the reason for the return is other than those mentioned above, the return cost will be fully borne by the customer.

PROMOTIONS
1. According to the laws currently in force, we can offer you special promotions.
2. Promotions are valid within the limit of available stock.

PRODUCT DELIVERY
1. Products that are in stock are delivered within 2-3 business days, from confirmation by an operator.
2. Products that come to order on an advance basis are delivered depending on the deadline established by the manufacturer, which can vary between 1 day and 5 weeks
3. For pre-orders and orders for products that are not in our stock, the deadline for confirming the delivery deadline is 7 business days.
4. Delivery is made by express courier, FAN COURIER or DPD anywhere in the country, where the company is headquartered. If there is no FAN COURIER or DPD office in your locality, 1 leu is added for each additional KM, or you can opt for the "Pickup from the office" option, which eliminates additional costs.
5. Please, when you pick up the package, carefully check its integrity. If the package is damaged please fill out a report together with the Fan Courier or DPD agent specifying the defects found. If you neglect to check the package upon pick-up and later find that the package is damaged, all responsibility is yours. Packages are checked upon pick-up, We do not accept subsequent complaints! Damaged products cannot be returned, according to point.
6. Transport costs are fully borne by the Buyer!
7. The shipping fee is calculated based on weight, by FAN COURIER or DPD, respectively:
  – first Kg – 15.00 ron
  – Additional kilograms – 0.80 ron / kg
  – refund fee: 5.50 ron (equivalent to the amount paid to the bank in the case of an advance payment)
  – VAT

CONFIDENTIALITY:
1. Any personal data such as: your name, address, phone number, CNP or e-mail address. that you send us via the SITE, EMAIL or by other means will be used in compliance with the laws currently in force, relating to this field (Law no. 677/2001 for the protection of individuals with regard to the processing of personal data and the free movement of such data)
2. MALLDECO collects the data to issue the tax invoice, which accompanies the product purchased by the BUYER, or the proforma invoice for the payment of the advance requested in the case of personalized orders.

PERSONAL DATA
1. The information of the users of the website www.MALLDECO.COM is confidential and may only be used for commercial communications with its partners. Any specific data regarding the situation and condition of the products can be obtained by contacting us online, at the coordinates contained in this site.
  
  On the website www.MALLDECO.COM, the user is responsible for all activities that occur by accessing the personal account and password. The seller S.C. TOP RESERVE BUSINESS S.R.L. cannot be held responsible for errors that occur as a result of the user's negligence regarding the security and confidentiality of his account and password.
  
  The processing of personal data is carried out in accordance with Law no. 677/2001 for the protection of individuals with regard to the processing of personal data and the free movement of such data.

SECURITY OF PERSONAL DATA AND INFORMATION
1. The personal data entered by the buyer will be used by the Seller only for the stated purpose of this site. The information in the order form is necessary to send you confirmation of orders, delivery of ordered products, announcement of ongoing promotions, etc., and will not be provided to a third party under any circumstances.
  
  The Seller guarantees the confidentiality of certain information. This data does not physically exist on the servers that run the www.MALLDECO.COM site, being accessible only by authorized personnel of the Company through the internal network. Each user has the right to see only his/her own personal data that he/she has entered.
  
  The website www.MALLDECO.COM uses security measures against the loss, alteration or misuse of information under the control of the Company.

ORDERING PROCEDURE
1. PLACEMENT OF THE ORDER: Any order is placed through our website, or by email to our address. We DO NOT accept PHONE orders. Orders are only accepted in writing.
2. ORDER CONFIRMATION: all orders submitted are checked and confirmed by our operators, who process your order. Without confirmation, no order is sent.
3. CUSTOMER UNAVAILABILITY: if our operators fail to contact a customer within 24 hours of submitting the order, the order is automatically canceled.
4. ORDER SUBMITTED, UNCONFIRMED: if you have submitted an order, but have not been contacted by the operators within a maximum of 24 hours, please contact us. Due to servers and computer systems, it may happen that it is not registered in our system.
5. TO START THE WALLPAPER PRODUCTION PROCESS, the order will be processed only after we receive written confirmation from the customer. This confirmation can be sent either via WhatsApp or by e-mail. In the absence of written confirmation, the order will not be processed. In the case of a photo wallpaper, the customer assumes responsibility for the wall measurements, including losses. Also, the customer chooses the image for the photo wallpaper and gives his consent for it after receiving the rendering from MallDeco (only if the customer chooses a different image compared to what is found on malldeco.com). ATTENTION! After the image rendering is accepted, the order is confirmed and put into operation, it cannot be modified.
